Yosemite Goddess Festival Art Exhibition
These Artist Terms & Conditions apply to all artists participating in the Art Exhibition at the Yosemite Goddess Festival (“Event”), produced by Kimberly Vaughan Enterprises, LLC (“Producer”).
By submitting an application and/or participating in the Art Exhibition, the artist (“Artist”) agrees to the following terms:
1. Curated Exhibition & Acceptance
The Art Exhibition is curated. Submission of an application does not guarantee acceptance. The Producer reserves the right to accept or decline artwork at its sole discretion to ensure alignment with the artistic vision, aesthetics, and logistical needs of the exhibition.
If an application is not accepted, any participation fee paid will be refunded in full.
2. Exhibition Space & Display Requirements
Artists are responsible for providing their own display systems, including but not limited to grids, easels, panels, racks, and other freestanding display structures.
Artists may not affix, tape, nail, pin, staple, glue, adhere, or otherwise attach anything to:
- walls
- beams
- ceilings
- doors
- permanent building structures
- drapes, curtains, poles, or décor elements provided by the Producer or venue
- Any damage caused to the venue or event décor by the Artist will be the sole responsibility of the Artist and may result in charges for repair or replacement.
The venue may have a limited number of tables available. Use of venue tables and the Producer’s black linens is offered when available but is not guaranteed.
3. Artwork Security & Supervision
The Producer does not provide security for individual artwork.
Artists are solely responsible for the security, supervision, and protection of their artwork at all times, including during setup, event hours, and teardown.
Artists are expected to remain with their work or ensure that a representative is present whenever artwork is displayed. The Producer, venue, and event staff are not responsible for loss, theft, or damage of artwork.
4. Sales & Commission
Artists may offer artwork for sale during the Event unless otherwise restricted.
All artwork sales are subject to a 20% commission payable to the Producer.
Participation fees paid for exhibition space will be applied as a credit toward commission owed. Any remaining commission balance must be settled following the Event.
Artists are responsible for collecting and reporting all applicable sales tax.
5. Participation Fees
Participation fees are based on the amount of exhibition space reserved and are used to support event operations, marketing, and administration.
Except in cases of non-acceptance into the curated exhibition, participation fees are non-refundable.
6. Liability, Risk & Artwork Damage
Artists understand and agree that participation involves inherent risks, including but not limited to damage, theft, loss, or destruction of artwork.
The Producer and venue assume no responsibility for loss or damage to artwork, materials, displays, or personal property.
Artists are encouraged to insure their artwork independently if desired.
7. Indemnification
Artists agree to indemnify, defend, and hold harmless Kimberly Vaughan Enterprises, LLC, the event venue, and all associated owners, employees, contractors, agents, and representatives from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from the Artist’s participation, artwork, display setup, sales, or conduct.
8. Compliance with Event Rules
Artists agree to comply with all event rules, venue regulations, safety requirements, and instructions provided by the Producer or venue staff.
Failure to comply may result in removal from the Event without refund.
9. Photography & Promotion
Artists grant permission for the Producer to photograph or record artwork and displays for promotional, marketing, archival, and documentation purposes without compensation.
10. Relationship to Overall Event Terms & Conditions
These Artist Terms & Conditions are in addition to, and do not replace, the Overall Event Terms & Conditions. Artists agree to be bound by both agreements.
11. Agreement & Legal Acceptance
By submitting an application, reserving space, or participating in the Art Exhibition, the Artist confirms that they have read, understand, and agree to these Artist Terms & Conditions. This agreement is legally binding.
Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Continued use of our websites or services constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
